The total cost of a Chapter 13 bankruptcy is around $3,200, but much of the cost can be rolled into your debt repayment plan. A Chapter 7 bankruptcy typically costs from $2,000 to $3,500, depending on the complexity of your case.
Attorney fees for Chapter 13 are set by a standing order of the local bankruptcy judges. Beware of attorneys advertising bargain-rate fees — their inexperience or "cookie cutter" approach could result in delay or rejection of your petition or cost you money in the long run by not taking full advantage of exemptions.
How long does it take?
A Chapter 7 takes about three months from the date of filing to discharge of debts. A Chapter 13 has a similar time frame for approval, plus monthly payments for three to five years.
Will I have to give up everything I own?
You will keep most if not all assets, including your home, cars and retirement funds. In fact, bankruptcy may be the only way to stop foreclosure and repossession.

Generally, unsecured debts are discharged. But you will have more money to pay the mortgage, student loans and other non-dischargeable debts.

How long will a bankruptcy stay on my record?
A bankruptcy will show up on your credit report for 10 years. However, your credit rating may already be bad if you are carrying a lot of debt and have not been paying bills on time. The bankruptcy typically becomes less important as you rebuild your credit rating by paying your bills on time.
