You Can Stop Foreclosure

It doesn't matter how you got to this point. If the bank or mortgage company has initiated the foreclosure process, or you have missed a house payment or two, the sooner you involve an attorney the better.

I am an experienced lawyer who has practiced consumer bankruptcy law in San Antonio, Texas for 25 years. I have helped many clients across Bexar County avoid foreclosure and get back on track. I will personally sit down with you to examine your financial situation and advise on the best course of action:

  • In Chapter 13 bankruptcy, you repay a portion of your debts over three to five years. If you are behind on mortgage payments, those arrears can be rolled into your Chapter 13 repayment plan. If you can afford the regular payment, the Bankruptcy Court will determine an amount that you pay each month to gradually pay off your past due mortgage, credit card bills and other debts.
  • Another option is a loan modification, through federal "bailout" programs or direct negotiations with your lender. My role is to make sure that the terms are fair, the costs of refinancing or restructuring are reasonable, and that you can afford to stay in the home.
  • If you are like many distressed homeowners, you may owe more than the home is worth in the current market. I can represent you in negotiations for a "short sale" to sell your house or deed in lieu of foreclosure to surrender the house to the bank. This allows you to essentially walk away from your mortgage.

Don't Wait Until the Last Minute

Unfortunately, there is not much we can do if the foreclosure sale is imminent and you may be forced out of your home in a week or two. It may be too complicated to stop foreclosure and get your ducks in a row at that point.

Ideally, you should contact a lawyer when you get behind on your mortgage and you know you can't catch up. But even if foreclosure has commenced, we may be able to help if you are a month or more from away from losing the house.
