A Fresh Start Through Chapter 7 Bankruptcy

Chapter 7 wipes out most unsecured debt, such as credit card balances and medical bills. You will still be responsible for your mortgage and other non-dischargeable debts, but by eliminating unsecured debt there will be a lot more money to cover those obligations. (See What Debts Are Discharged?)

As soon as we file your Chapter 7 petition with the Bankruptcy Court, all creditor actions must stop. This includes the harassing phone calls from credit card companies, threats from collection agencies, foreclosure proceedings and vehicle repossession (if you keep up your mortgage and car payments).

Are You a Candidate for Chapter 7?

In my experience as a bankruptcy attorney, most Bexar County residents qualify for Chapter 7 under the income guidelines, but there are other factors to consider. Chapter 7 may not be an option if:

  • You earn too much under the income means test
  • You have substantial assets that would not be exempt
  • You are months behind on the mortgage and facing foreclosure
  • You are morally opposed to walking away from your debts

In each of these cases, you may still qualify for a Chapter 13 debt repayment plan, which halts creditor actions and spreads your debts out over several years.
