Chapter 13 Bankruptcy

If you do not qualify for a straight discharge of debts through Chapter 7 bankruptcy, a Chapter 13 filing still provides a great measure of financial and emotional relief. In Chapter 13, I negotiate a repayment plan, based on what you can afford to pay toward your debts after household expenses.

You will pay a set amount for 36 to 60 months. It is very important that your repayment plan be realistic. If you can't keep up with your Chapter 13, you will have to start over and face foreclosure and collection agencies again. Thus it is critical that you have an experienced attorney handling your case.

Keep Your Property and Get Creditors Off Your Back

You do not surrender any assets in a Chapter 13. As soon as we file your petition, creditor harassment must stop, including phone calls and actions to repossess or foreclose on your property. As long as you stay current on your mortgage and car payments, you are under Bankruptcy Court protection and those creditors cannot initiate or continue legal action.

Committed to Honoring Your Debts?
If you are eligible for Chapter 7 under the income means test, but your sense of pride or moral objections will not let you walk away from debts, Chapter 13 provides a solution. If you make all the scheduled payments in good faith, any remaining debt is forgiven by your creditors. You will begin to rebuild a solid credit rating and emerge from Chapter 13 bankruptcy without debt and your head held high.
